Supplemental Privacy Notice for U.S. Residents

The California Consumer Privacy Act (“CCPA”), as amended by the California Privacy Rights Act (“CPRA”), created a set of privacy rights for California residents. Since that time, additional U.S. states have enacted comprehensive privacy laws that provide similar rights to their residents (collectively, “U.S. State Privacy Laws”).

This additional privacy notice for U.S. residents, and is intended to make the disclosures required by these U.S. State Privacy Laws, in addition to the information provided in the Motorola Website Privacy Statement.

The Motorola Website Privacy Statement describes, among other things, the categories of personal information Motorola collects (including sensitive personal information, where applicable), the sources of that information, the business and commercial purposes of use, and how long the information is retained, and whether the information is disclosed to third parties. This Supplemental Privacy Notice provides additional information relevant to U.S. State Privacy Laws, including disclosures and rights related to the use of personal information for advertising, sale or sharing, and targeted advertising purposes.

Motorola limits the collection, use, and retention of personal information to what is reasonably necessary and proportionate to achieve the purposes described in its Privacy Statement, consistent with applicable U.S. State Privacy Laws.

Sharing of personal information with third parties

Some advertising and tracking technologies operate in ways that may involve independent decision-making regarding the processing of personal information. As a result, disclosures to these providers may be considered disclosures to third parties under certain U.S. State Privacy Laws, even when contractual restrictions are in place. In the preceding 12 months (measured from the date of this notice), Motorola has shared to advertisers, ad networks, advertising partners, social media networks, and advertising measurement providers the following categories of personal information:

  • A. Identifiers including, device identifiers, advertising identifiers, IP addresses, browser cookies, and other unique online identifiers
  • B. Internet activity information including data about a consumer’s interaction with an Internet website, application, service, or advertisement
  • C. User Profile information including email address and general location information
  • D. Inferences drawn from Personal Information, including preferences, interests, and other data used to personalize a consumer’s experience

Categories A through D are each shared with the third parties identified above and processed by Motorola for cross contextual behavioral advertising purposes, for targeted advertising purposes, to target ads, and to provide analytics and reporting related to the effectiveness of advertising.

Motorola does not have actual knowledge that it sells or shares for cross-context behavioral advertising purposes, or processes for targeted advertising purposes, the personal information of consumers under 16 years of age, nor does it knowingly collect or process the personal information of consumers under 13 years of age.

Summary of your data privacy rights

Some U.S. State Privacy Laws grant consumers certain rights regarding their personal information. We honor requests in accordance with and to the extent required by applicable laws, which may vary depending on where you live. Depending on your state of residence, your rights may include:

  • The right to know and access the specific pieces of personal information we have collected about you in a portable and, to the extent technically feasible, readily usable format.
  • The right to correct inaccurate personal information that we maintain about you.
  • The right to request deletion of the personal information that we have collected about you.
  • The right to opt-out of the processing of your personal information for targeted advertising, the sale of your personal information, or the sharing of personal information for cross-context behavioral advertising.
  • The right to limit our use or disclosure of your sensitive personal information, where permitted by law. Motorola does not use or disclose sensitive personal information except as permitted by applicable U.S. State Privacy Laws, including for purposes that are reasonably necessary and proportionate to provide requested products and services.
  • The right to be free from discriminatory treatment for the exercise of your privacy rights.
  • The right to appeal any decision with regard to your privacy request.
  • The right to opt-out of profiling in furtherance of producing legal or significant decisions concerning a consumer. We do not engage in such profiling.
  • Other rights to request information from us under applicable state laws – including, in certain states, the right to request a list of the third parties to which we disclosed personal information. This list may also be available if you click the Cookie Consent Tool link in our site footer.

You can submit a request to exercise the rights applicable to you through our Privacy Request Form or by contacting Motorola at privacy@motorola.com. Motorola does not discriminate in response to privacy rights requests. We may deny certain requests, or fulfill a request only in part, based on our legal rights and obligations. You may also use an authorized agent to submit a privacy request form on your behalf. If you do so, Motorola will require: (i) you to provide the authorized agent written permission to do so; and (ii) your agent to verify their identity directly with Motorola. Motorola may deny a request from an agent that does not meet these requirements.

Financial incentives

We may offer financial incentives in exchange for the collection and use of your personal information. These incentives may include discounts, rewards, or other benefits provided when you subscribe to marketing communications or participate in promotional programs. The material terms of the financial incentive will generally be presented to you at the time you sign up. You may withdraw from any financial incentive at any time by emailing us at privacy@motorola.com.

Notice of right to opt-out of sharing

In an increasing number of U.S. States, you can request that Motorola not: (a) sell your personal information, (b) share it with third parties for cross-context behavioral advertising purposes, or (c) process it for targeted advertising purposes.

We honor certain browser-based opt-out signals where required by applicable law for your browser or device. We do not respond to other signals that do not meet applicable legal requirements or are not yet uniform, which may include older “Do Not Track” signals.
